A TEENAGER battered a man who was cleared of murdering his stepdad.

He kicked and stamped on his victim with pals in Fraserburgh, Aberdeenshire, in the broad daylight assault.

Aberdeen Sheriff Court was told James decided to dish out some justice of his own because a jury did not convict David of murdering his stepfather Gary Clampett.

Gary, 39, was slaughtered in a horror street attack by a gang armed with a machete, sword, chain, hammer, crowbar and knives.

The Press and Journal revealed James walked from court with community service after a beak accepted there was some background to the incident.

Prosecutor Ruaridh McAllister said: “The complainer, David Graham, was previously in a murder trial in relation to the murder of Gary Clampett, the accused’s stepfather.

“He saw James Graham and someone else exit from an address to his left and he saw that James Graham was holding a silver metal pole.

“They chased him along the street and caught up with him and he fell to the ground.

“Both began to kick and stamp on David Graham to various parts of his body.”

The court was told that James got two other men to join in the attack and they also stamped and kicked David.

Mr McAllister said that as the victim tried to walk away one of the crew stamped on his ankle.

David was examined at hospital and suffered swelling, bruising and tenderness to his head, ribs, hand and ankle.

James, now 18, admitted a charge of assault to injury over he March 2020 attack.

Sheriff Andrew Miller slated James for the attack. He said: “The offence was undoubtedly a serious matter in which you and another man effectively took the law into your own hands by assaulting this man.

“I take into account there’s a background here but I make it clear that does not excuse the offence.

“It does at least provide an explanation of sorts, which allows me to assess your motivation and why you took part in this offence.”

James was handed 120 hours of unpaid work and 12 months supervision.

His mum Sharon told how she tried to shield hubby Gary from the gang who butchered him in June 2017.

But he was stabbed twice in the chest by a gang in a row that was sparked by a Facebook comment.

John Henderson, Gary Martin, Thomas Martin, James Connor, and Dean Leech were convicted of murder and caged for a total of almost 100 years.

David Graham walked on a not-proven verdict in May 2018.
