Men who were disgusting to women among those sentenced by Cornwall magistrates

One beat a woman, one threatened a woman with violence and one shared an intimate photo or film without consent, included in this week’s magistrates’ list

It’s the weekend and therefore time for a look at the cases that have recently come before Cornwall’s magistrates’ courts. Everyone who has been charged with an offence, from minor crimes to the most serious, appears initially before the magistrates.

The most serious cases are then sent to Truro Crown Court. If a defendant pleads guilty, they could be sentenced straight away or have the matter put back for a pre-sentence report. If they deny the allegations against them, the case will be adjourned for a trial.

The courts are open to anyone and our reporters attend just like any other member of the public. As most people have jobs and cannot spend their time in court, the media has always acted as the eyes and ears of the public to ensure that justice is seen to be done.

Here’s who has been sentenced at the magistrates’ courts in Bodmin and Truro recently.

Jonathan Simpson

Age: 29

Island Crescent, Newquay

Burglary dwelling and theft – no violence. On June 17 in Trevanion Road, St Austell, having entered as a trespasser a dwelling stole therein a gold coloured ring and pendant of a value unknown.

Community order. Alcohol treatment: 6 Months. Rehabilitation activity: 15 Days.

Costs: £135. Surcharge: £114.

Jonathan Capewell

Age: 56

Bryher Close, Kelly Bray, Callington

Criminal damage to property. On December 26, 2024, at Boconnoc Avenue in Callington without lawful excuse, damaged a mobile phone to the value of unknown belonging to a woman intending to destroy or damage such property or being reckless as to whether such property would be destroyed or damaged.

On December 28, 2024, at Well Street in Callington without lawful excuse, damaged the passenger side window of a vehicle to the value of £75 belonging to a woman intending to destroy or damage such property or being reckless as to whether such property would be destroyed or damaged.

Assault a person thereby occasioning them actual bodily harm. On December 28, 2024, at Well Street in Callington assaulted a woman thereby occasioning her, actual bodily harm.

Community order. Alcohol treatment: 6 Months. Compensation: £155. Costs: £135. Surcharge: £114.

Eric Roberts

Age: 82

Chapel Meadow, Callington

Assault by beating. On March 9 at Chilsworthy assaulted a woman by beating her.

Conditional discharge: 6 Months. Costs : £85. Surcharge: £26.

David Michael

Age: 35

Polkyth Road, St Austell

On October 25 at St Austell caused a woman to fear that violence would be used against her by your course of conduct which you knew or ought to have known would cause fear of violence to a woman on each occasion in that you sent multiple offensive and threatening messages, where you threatened to use violence towards her.

Assault by beating. On October 24 at St Austell assaulted a woman by beating her.

Community order. Alcohol treatment: 6 Months. Programme – Number of days: 27 Days. Rehabilitation activity: 20 Days. Restraining order not to contact your victim for three years.

Costs: £135. Surcharge: £114.

Sarah Penfold

Age: 52

Dudnance Lane, Pool

Assault by beating of an emergency worker. On August 23 at Commercial street in Camborne assaulted a emergency worker, namely a police officer, acting in the exercise of his duties, by spitting in his face.

Use threatening / abusive words / behaviour likely to cause harassment, alarm or distress. On the same day at Trelowarren Street in Camborne used threatening or abusive words or behaviour or disorderly behaviour within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby.

Community order. Alcohol treatment: 6 Months. Rehabilitation activity: 15 Days. Compensation: £100. Fine: £200.

Ricky Bushell

Age: 60

New Farm, Higher Worthyvale, Camelford

Share photograph or film of person in intimate state without consent contrary to section 66B(1) and (9) of the Sexual Offences Act 2003. The offence took place on September 25 at Llandudo in Wales.

Same place, same charge happening between July 20 and October 7.

Fail to surrender to police / court bail . On October 9 at Cheltenham failed without reasonable cause to surrender to custody at Cheltenham Magistrates’ Court, having been released on bail in criminal proceedings on 07 Oct 2025 at Compass House Custody Suite.

Community order. Rehabilitation activity: 25 Days. Unpaid work: 200 Hours. Restraining order not to contact your victim or post images or other information about her anywhere online.

Jarrod Westlake

Age: 35

No fixed abode, Falmouth

Assault by beating. On November 16, 2024 at Killigrew Street in Falmouth assaulted a man by beating him.

Use threatening / abusive words / behaviour likely to cause harassment, alarm or distress. Same day and same place.

To be detained in the courthouse. One day detention deemed by time served.

Thomas Hewer

Age: 37

No fixed abode, Camborne

Burglary other than dwelling. On November 29 at Trelowarren Street in Camborne having entered as a trespasser a building, namely Crystal Image, stole property to an unknown value.

Total custodial period: 24 Weeks, Imprisonment Period: 24 Weeks, Imprisonment reasons: the offence(s) are so serious that only a custodial sentence can be justified, Reason for custody: because pre-planned, wherein you disguised yourself, armed with a weapon, in the middle of the day, on a busy shopping Saturday, in the presence of public and children and subsequent loss to the business.

Compensation: £500. Costs: £135.
