Oxfordshire woman guilty of causing death of boyfriend

Courtney Goodwin-Diliberto, 24, was on trial at Oxford Crown Court charged with of causing the death of her boyfriend, Ben Ireson, after causing him to overtake her on his motorcycle after braking in front of him. 

He then hit a Royal Mail lorry whilst overtaking on a blind bend.

The incident took place at the junction of Frax Close and Faringdon Road in Kingston Bagpuize in the early hours of the morning on April 28, 2022.

Goodwin-Diliberto, of Aldiss Drive, Kingston Bagpuize, had denied the offence – telling police that Mr Ireson had being going ‘too fast’ and the lorry driver has been an ‘idiot’.

After two days of deliberations, a 12-strong jury found the defendant guilty of one count of causing death by dangerous driving. They did need to consider the alternative charge of causing death by careless driving when over the prescribed limit for cannabis.

During the trial, which started last week, it was heard the defendant had been driving a white Ford Focus while Mr Ireson, who was 26 at the time, had been riding his Yamaha motorbike.

They were first seen on CCTV at the McDonald’s restaurant in Abingdon shortly after 12.32am and used the drive thru.

They were then seen on CCTV from the Shell Garage in Frilford at 12.42am, with Mr Ireson driving directly behind the defendant.

It was heard the defendant had braked ‘suddenly’ whilst driving into Kingston Bagpuize, causing Mr Ireson, formerly of Bow Bank, Longworth, to overtake and collide head-on with a Royal Mail lorry.

Police officers stationed in Didcot were alerted to a road traffic incident at 12.50am.

Bodycam footage of one of the officers after they arrived on scene showed the defendant sat on the floor shaking and crying.

She could be heard saying: “It was my fault because I went round the corner and had my foot on the brake and he had no choice but to overtake me.”

Goodwin-Diliberto’s case has been that Mr Ireson had already completed the overtake and was in front of her when he collided with the lorry as its wheels had been ‘over’ the white line.

She told police: “If they went over the middle Mr Ireson would have been fine, if anything he’s [the lorry driver] to blame because he was in the f****** way.”

However, the jury rejected her version of events.

Goodwin-Diliberto has admitted to being over the drug-driving limit at the time of the offence, having consumed cannabis.

She will now be sentenced at the same court on May 20.
