A young man who had sex with a girl when he was under 18 has been spared prison. Benjamin Fisher, 21, of Brisbane Terrace in Liskeard, was told by a crown court judge that had he been 18 at the time of the offence, he would have looked at a lengthy prison sentence.
A sentencing hearing at Truro Crown Court today (Friday, June 13) heard how Fisher had sexual intercourse with a girl who was under 16. Fisher, who was acquitted at trial of rape, had pleaded guilty to three offences of engaging in penetrative sexual activity with a girl under 16 while being under 18 in connection with the incident.
His Honour Judge James Adkin told Fisher that had he committed the offences while being over the age of 18 he would have looked at a lengthy prison sentence.

“You were a child yourself when you committed these offences,” he told him. He sentenced Fisher to a 12-month community order and mental health requirement order with 12 sessions as well as a four-month curfew to reside at his home address.
Fisher was not made to sign the sex offenders register.
